4.1 Key Information

The now accused Murtaza Rasul is 35 years of age having been born o

The accused is employed as a Sub-Post Master at Carmyle Post Office, Carmyle, Glasgow where he
has held the position for a period of approximately 10 years. The accused receives a remuneration
package from Post Office Ltd of approximately: i

4.3 Summary of Evidence

4.3.1 Description of locus

The locus of the charge libelled is Carmyle Post Office which is situated within the residential area of
Carmyle in Glasgow's East End.

The locus is a sub-post office which provides a service to the local community within the Carmyle area
and allows patrons to conduct their financial transactions locally as opposed to travelling out-with.

The locus has internal CCTV coverage however during the course of enquiries it was established that
the CCTV system retains footage for a period of approximately 4 days.

4.3.2 Description of event

BACKGROUND

Between 8 June 2010 and 2 April 2012, three reports of Fraud were made to Police, all of which
were alleged to have occurred at Carmyle Post Office. The complainers in these incidents were
elderly females who held Post Office Accounts and conducted their withdrawals/transactions utilising
a withdrawal card and Personal Identification Number. Each complainer had an amount of money
withdrawn from their Post Office Accounts without their consent or knowledge. All complainers
conducted their associated business at Carmyle Post Office - Crime Report Nos PSPBD01710610,
PSPBD01040810 and PSPBD00290412 refer.

The complainer, the witnessI = GRO} 87), was the holder of Post Office Account No! GRO.

Prior to 13 April 2010, the account balance was £17,114.81. It was later established through

interrogation of Post Office statements relating to this account that between 13 April 2010 and 27 May
2010, 30 x withdrawals of £600 (six hundred pounds) had been taken from the account.

Through enquiries made by family members it was established that 4 x withdrawals of £600 were

family. A statement was also noted from the Sub-Postmaster at Carmyle
Post Office, now know! accused Murtaza Rasul. During his statement, the accused Rasul stated
he recalled the witness! having attended for a period of a few weeks to withdraw money
from her account whilst accompanied by family members. Further enquiries carried out with members of
the witness family confirmed the witness ad attended at the Post Office,
however not for the prolonged period described by the accused Rasul.

were also seized. Statements were also noted from relatives of the accused Rasul who had been
covering periods of annual leave taken by the accused.

On 30 April 2010, the balance of this account was £13,318.43. It was established through interrogation
of Post Office statements relating to this account that between 7 May 2010 and 2 June 2010, 19 x

withdrawals totalling £11,400 were carried out from the account without the knowledge of consent of the
account holder, the witness,

matter and han Post Office Account Card which his mother had in her possession. At that
time the witness }was informed that the Post Office Card was in fact an unregistered card
and he was advised by staff (not further described) to destroy the card, which he did. The location of the
true card has not been established. A new card was issued on 21 June 2010 and it was noted no further
fraudulent transactions occurred since that date.

were generated. It was noted that between April 2010 and August 2010, the accused received a net
salary totalling from Post Office Ltd.

On 12 October 2011, the accused Murtaza Rasul attended at Shettleston Police Office in order to
assist with enquiries. The accused provided a statement which detailed his personal finances. At the
conclusion of the statement the exact m been withdrawn from each Post
Office Account relating to the witnesse “Icould not be established.

The complainer, the witness! (86), was the holder of Post Office Account No

Prior to 24 June 2017, the balance of this account was £4,544.38. It was later established
through interrogation of Post Office statements relating to this account that between 24 June 2011 and
6 March 2012, 7 x withdrawals of £600 (totalling £4,200) had been taken from the account without the

knowledge or consent of the witness.

On 2 April 2012, the witness: icontacted Police to report the incident. The Police witness Alan
Duff subsequently attended at her home address and noted details for a Crime Report, during which the
Police witness Duff seized

The Police witness Paterson conducted further enquiries into the incident and further liaised with the
witness Daily, Security Manager of Post Office Ltd.

About 1100 hours on 27 April 2012, the Police witness Paterson accompanied by the witness Daly
attended at the witness; home address. A statement was noted from the witness:
who confirmed she had attended at Carmyle Post Office and had been served on each occasion by

a male staff member she knows as "Danny" (confirmed as the accused Murtaza Rasul). The witness
inserted her Post Office Card, Account No, into the Horizon Automated
System, when prompted she entered her Personal Identification Number (PIN) and verbally asked the
staff member for the sum of £150. The witness) eceived the sum of £150 on each occasion,
however did not receive a receipt on the dates where the sums of £600 had been recorded on the Post
Office Account.

About 1445 hours on 13 August 2012, the witness Daly attended at Shettleston Police Office where he
provided a self-written statement to the Police witness Paterson which related to the operation of the
Horizon Automated System. From this statement it was established that the Horizon Automated System
could be manipulated in such a way that would allow a customer to key in their Personal Identification
Number, request the sum of £150, however at the vendor side the staff member would have the option
to press "Withdraw Limit" from the touch screen panel. To confirm the transaction, the customer would
again be prompted to re-enter their Personal Identification Number. The vendor would then hand over
the originally requested sum of £150, however by selecting the "Withdraw Limit" option this would allow
a withdrawal limit of £600 (providing there were sufficient funds available), thereby the vendor would

have the opportunity to steal the amount of £450 without the customer's knowledge. No receipt would be
issued as this would reflect the actual transaction of £600.

About 0840 hours on 20 February 2013, the Police witnesses Paterson and Dianne Wilson traced the
accused Murtaza Rasul at Gardenside Avenue, Glasgow at which time he was detained under terms of
Section 14 of the Criminal Procedure (Scotland) Act 1995. The accused made no comment at that time.

The accused was thereafter conveyed to Maryhill Police Office where his arrival was timed at 0920
hours, same date.

The grounds for the accused's detention were accepted by the Duty Officer. The accused was
processed and

Between 0936 hours and 0937 hours, same date, the Police witness Paterson, in the presence of the
Police witness Wilson, informed the accused Rasul of his rights to have access to a solicitor prior to
Police interview, at which time the accused declined the offer of a private consultation prior to interview
and signed

Between 1015 hours and 1203 hours, same date, the accused Rasul was interviewed under tape
recorded conditions within Interview Room No 2 of Maryhill Police Office by the Police witnesses
Paterson and Wilson. Tape Ref No BE13020186 refers.

At 1200 hours, same date, the accused was informed he was no longer a detained person and was
under arrest. The accused was thereafter cautioned and charged as libelled by the Police witness
Paterson, in the presence of the Police witness Wilson, and his reply noted.

At the conclusion of the interview, the accused Rasul was removed to the Charge Bar where he was
informed of his rights as an arrested person.

The accused was informed that matters would be subject of a report to the Procurator Fiscal and was
later liberated.

About 1215 hours, same date, the Police witness Paterson seized

4.3.4 Interview

Between 1015 hours and 1203 hours, same date, the accused Rasul was interviewed under tape
recorded conditions within Interview Room No 2 of Maryhill Police Office by the Police witnesses
Paterson and Wilson.

The accused displayed a thorough working knowledge of the Horizon automated system used within the
Post Office commensurate with his position. The accused agreed that the suspected method used to
withdraw monies from the witness” Post Office account was a possible procedure. However,
he denied all allegations put to him.

4.3.5 Caution and charge/reply

Between 1015 hours and 1203 hours, same date, the accused Rasul was interviewed under tape
recorded conditions within Interview Room No 2 of Maryhill Police Office.

At 1200 hours, same date, the accused was informed he was no longer a detained person and was
under arrest. The accused was thereafter cautioned and charged as libelled by the Police witness
Paterson, in the presence of the Police witness Wilson.

The accused stated he fully understood the charge to which he replied, "YEH, IT WASN'T, I DIDN'T DO
IT THE WAY YOU'RE SAYING THATS WHAT HAPPENED. I BELIEVE THE CUSTOMER WITHDREW
THAT MONEY AND MISPLACED THE RECEIPT SOMEWHERE BECAUSE RECEIPTS WERE
ISSUED ON EVERY SINGLE TIME AS THEY ARE WITH EVERY SINGLE TRANSACTION."

At the conclusion of the interview, the accused Rasul was removed to the Charge Bar where he was
informed of his rights as an arrested person.

The accused was informed that matters would be subject of a report to the Procurator Fiscal and was
later liberated.

4.4 Analysis of evidence / Identification of accused

Police with enquiries in relation to all three reports of Fraud having occurred at locus, to providing
technical knowledge of the operation of the Horizon automated system to the reporting officer in order

to progress the enquiry and provide sufficency of evidence, to providing a statement to the Police. The
witness Daily should be considered as an expert in the operation of the Horizon automated system.

4.5 Remarks

The accused has held the position of Sub-Post master at locus for approximately 10 years. In relation to
the first two occurrences the method by which the monies were taken from each account is cannot be
established at time of submission of this report. It should be noted that all three complainers are elderly

females in their eighties and have lost significant portions of their savings as a result of these despicable
acts.

The witness Daily (Post Office Security Manager) has highlighted a method by which the Horizon
automated system can be manipulated to conduct the theft of monies by fraudulent means as
documented within the description of events. A full statement in relation to same has been obtained from
the witness Daily which explains in depth as to how this would be done.

Statement's have been noted from members of the witnes: family. They have not been
added as witnesses in the case meantime and are available for perusal at your request.

Throughout the tape recorded interview the accused displayed a thorough working knowledge of the
Horizon automated system used within the Post Office commensurate with his position. The accused
agreed that the method used to withdraw monies from a Post Office account as described previously by
the witness Daily was possible. However, he denied all allegations put to him.

4.6 Further Enquiries

It should be noted the accused was interviewed in relation to all three occurances of Fraud howver it was
deemed there was insuficent evidence to libel any charges in relation to the first two occurances namely
PSPBD01710610 and PSPBD01040810. The reporting officer will conduct any further enquiries should
any further instructions be issued by the Procurator Fiscal.
