Thank you for today sending to us a copy of your fax dated 20 December 2006 to the Court.

We enclose the Tivoli events log that Fujitsu have now extracted from their archive for Marine Drive. We
are advised that this contains the data that Anne Chambers checked in 2004 and it is the data she
referred to in her evidence at the trial. (Although the formatting is slightly different from how Ms
Chambers would have seen it because it is extracted from the computer archive, the substance is
identical).

When we spoke to you on 20 December, you were unaware as to whether or not you would proceed with
your application. In the circumstances, please confirm as a matter of urgency whether you are intending
to proceed and if so, what exactly it is that you are applying for and when that application has been listed
for hearing. In the event that you do proceed with your application, we do need sufficient notice so that

travel arrangements can be made.
