Please find enclosed copy of letter sent to the Defence. I have decided not to question the
Defence Statement in any details on the basis that at Paragraphs 1 and 5 they not only seem
to accept the figure of £11,957.78 as being missing but also that it ought to be repaid to Post
Office Ltd. This must mean therefore that they cannot maintain that Horizon was
malfunctioning otherwise they would be disputing the repayment. Hopefully I will receive the
cheque for monies owed to Post Office Ltd in this Office prior to the trial date, but in any event
Counsel can presumably rely on the contents of the Defence Statement to challenge on what
specific basis the defence is being run. I would not want the Defence to be alerted to such a
challenge prior to the actual hearing.
