The only other point is that Castleton would like each party to instruct 2 experts i.e 1 in accountancy and 1 in
information technology, instead of combining these skills in 1 person. This goes to the core of Castleton's
"defence" that the shortfalls were caused by computer errors so I think on balance the Court may well agree to
this. (It doesn't stop us instructing an IT literate accountant and we don't have to instruct an IT expert if you think
it is not nec).
Have you any objection to this?

No objection to the slacker timetable subject to witness availability latter on in the year towards Xmas.
Bajaj has not as yet issued proceedings so tactically a decision on Castleton or better still Castleton disappearing
would be advantageous.

Dear Mandy,
I refer to our telephone conversation on 6 March.
Castleton's solicitors have come back to me with some revised directions (copy attached). Basically, they have
just put the dates back to allow more time for disclosure, witness statements and expert reports, which I
anticipate the P.O will welcome. The trial would be between 20 October and 22 December. I am inclined to
agree most of these directions unless you have any objections (although I would like the trial window cut off to
be slightly earlier in December, as this will help witness availability).
Is there any tactical preference for getting Castleton tried before Bajaj or the other way around? It sounds as
though Bajaj has not issued a claim yet so presumably it would be helpful to have a favourable judgment on
Castleton asap before Bajaj goes to trial (if either of them get that far).
I look forward to hearing from you as soon as possible.
