Dear Mike,

As we discussed at the meeting with Dave Miller and Richard Christou on
Monday, we are now nearing the end of the Acceptance process, and it is
important that all activities are concluded in a timely manner.

Under the Codified Agreement, all ICL activities in relation to analysis,
classification and retesting of Acceptance Incidents are due to be completed
by the end of the two week period referred to in paragraph 2.4 of schedule
A11, allowing a minimum of 1 week for Post Office Counters Limited to
review your analysis and classification of incidents, and the outcome of any
re-testing undertaken to enable Acceptance Incidents to be cleared (or
replaced by ones of lower severity).

Formally, the above 2 week period ended on 9 August, ie. 2 weeks after 26"
July. As we stated on Monday Post Office Counters Limited is prepared to
allow an additional 2 days, until 11% August, on condition that the
Acceptance Review period is also extended, from 16" to 18 August, the date
now scheduled for the Acceptance Board, to maintain the 1 week available for
review by Post Office Counters Limited. We also offered to consider requests
for further extensions in relation to specific Acceptance Incidents on a case by
case basis, but have not received any requests for such extensions.

Therefore, Post Office Counters Limited now requires all of the relevant
information that you are contracted to provide, in order for us to be able to
carry out the analysis we need to complete prior to the Acceptance Board.
Please therefore provide, by close of business today, 11 August:

1. Your analysis and classification of all Acceptance Incidents where the
status is “pending”;

2. Results and analysis of all retesting you have completed in relation to
Acceptance Incidents still open.

Dear Mike,

Thank you for your letter of today, requesting an extension to the contractual
deadline for completion of your analysis of Acceptance Incident 298. I have
considered this with Bruce McNiven, and Chris French. We are not able to
agree to your request, since there would be insufficient time for Post Office
Counters Limited to review any new information that you provided. I note
that this Acceptance Incident was first raised in early July, following analysis
of the Horizon System Help Desk Log by our programme staff, and that
Pathway have already had more than 5 weeks for investigation and analysis
of the problem.

Post Office Counters Limited could only consider an extension to the
timescale for analysis of this Acceptance Incident in the context of an
adjustment to the overall Acceptance timescales. However, in the meantime,
we would encourage you to continue your efforts towards rectification of this
high severity deficiency in the services.
