HI Dave
Thave pul the above case for write off due to the circumstances, before It can be authorised my senior
line manager has asked for me to confirm the foliowing:-
4. Was Misra declared bankrupt? Yes, she was declared bankrupt prior to the POCA hearings.
2. Will POCA be revisiting the case? Probably not ... though a £1 order was authorised and this
enables us to revisit a case, in reality we have never had the time to revisit a case (though the
theory being that if a suspect comes into inheritance, lottery win, etc, then we can claim It). That's
not to say that we may revisit in the future. .

All, .
It would appear that the case was closed from a criminal investigation perspective last year, but the
Financial Investigation should have remained as an open case (and be reported on our monthly
spreadsheel).
That said, I can confirm that Misra satisfactorily demonstrated to the court and prosecution that there was
no equity left for confiscation purposes in the property she owned. ‘This was the only asset and it was re-
possessed (documentary evidence was supplied). The loss was £74.6k, property sale was £150k (minus
disbursements).- Hackney Homes (ground rent owed) received £14k and the Woolwich recelved £130k ...
«this still left £1.1k outstanding on the mortgage. As such, the scope for civil recovery looks bleak.
+ Chiris was correct in his previous email ... a £1 Order isn't a case of the Defendant only being penalised
to the tune of £1, it means we can review/revisit the case at any time in the future, with a view to applying
for Confiscation on any assets held at that time (inheritance, lottery win, savings, mortgage, etc).

Hi Paul
I refer to the latest developments below, could you please confirm if you attended the confiscation
hearing? Also I know that Ms Misra's house had been re-possessed and back in January was being sold,
do we know how much this went for and where the money went? Obviously if the house was re-
possessed then Ms Misra would not have received any payment from the sale.

Dave
The Misra case was closed 1 March 2011 but she has been in court in April 2012 re confiscation hearing
see new article on link below. .
Can we have a update on this and a view on if any further work re Civil recovery would be viable asit
looks like there are no assets left here to go after
This is one of the cases on our Horizon issues Spreadsheet that we may need to close.
Cheers Alison
