Helen, please see my email below. I know that you provided a short statement in this case. I have
spoken to both Steve and Robert Daily about it and I am confident that they will be able to obtain the
evidence that I have requested, but wanted to keep you in the loop.
Sharron - I just wanted to copy you in as I have asked other investigators to use your s.9 to show the
POL's stance on criticisms to Hz system. Note - I want them to copy and paste the content and put their
signatures on it, so don't worry.

Post Office Ltd v. Kim Wylie - Trial listed 17th Dec at Newcastle Crown Court
Please find attached:
1. Acopy of the Defence Case Statement
2. letter from defence solicitors requesting further evidence
The defence case statement is a legal document that sets out the defendant's version of
events and puts the prosecution to proof on elements of the case. As we are bringing
the case, we must provide sufficient evidence to justify the charges that we have
brought against the accused.
The trial is coming up shortly and the defence have requested further evidence covering
the following issues:
1. Defence claim that Wylie was on holiday in November 2008, and a stand-in

subpostmaster covered for her whilst she was away, possibly a Mr Adrian Corner. Please
Ou enquiries be made to see who in fact was standing in throughout November 2008; and
most importantly, whether there were any problems with the Horizon system during that
time. The defence have requested copies of BTS for that time period, are these available? If any
of them are available please obtain copies so that I can serve them.
2. Financial Enquiries - Defence would like to know what enquiries were made into Ms
Wylie's bank accounts / financial background. They have said that she gave her authority for
investigations to be made, but would like to see what enquiries and evidence (if any) have
been obtained by POL investigators.
3. Possible audit in 2004 - Defence claim that an audit was carried out at the Winlaton Post
Office back in 2004. Having discussed this with Robert Daily earlier today, it may well be the
case that any records of the audit have since been deleted through the housekeeping process.
Please could enquiries be made, and if it is the case that POL no longer hold any of those
records, we can simply say that in a s.9 format.
4. Horizon complaints / questioning intergrity of the system - I have a copy of the expert
Gareth Jenkins report which deals with general criticisms of the Horizon system. I will write
to Gareth to ask him if we can use this report for this case, (it will be a bulk request as I have
other cases where an unspecified criticism of the system has been made). I will serve this, as
soon as I have Gareth's consent to serve it.
- Please see attached - s.9 from Sharron Jennings. The content of this s.9 has been approved
by Jarnail to serve in cases where defence raise the issue of complaints made against the
system. It is the official stance taken by the Post Office. Please could content of the attached
s.9 be simply cut and paste with an investigator's signature, once it has been read and
approved.
The further evidence that I have listed above needs to be covered in a s.9 statement ideally
from investigators that have already provided statements in the case, that way it can be a
‘further to' statement and provide continuity. Any items of evidence discovered which
illustrates the areas above will need to be exhibited within the correponding s.9.
DCS - point 2 - The defence have said that Wylie's terminal was removed following her
suspension - does any one know why this happened and what was found as a result?
I hope this note assists. I will forward this email on to counsel Barry Robson for his
consideration, there may be areas where counsel would like further evidence, or a further
paragraph etc adding in, but I will liaise with him and update you if that is the case.
