e POL Security are seeking to prosecute Miss Merritt via a summons. Helen — are you able to update us on any
progress please?
Having received this file from Gary Thomas on 21* March, I raised summonses for three counts of False Accounting
(please see attached). As you can see the summonses were for 11:00 on 3 May 2012 at Yeovil Magistrates Court.
Prior to issuing the summonses I was asked to delay sending them to Ms Merritt to give Jarnail Singh, Head of Criminal
Law chance to review the case. I have now written to the court asking for them to vacate this date pending further
instructions.
When requesting a court date I normally give a lead time for 6 weeks giving enough time for both parties to prepare.
Therefore, if I raise fresh summonses this week I will be looking to book in at the earliest for the end of May.

Apologies for the delay in my response, as Matt made you aware in his email I only returned from leave yesterday
Matt has done a pretty good job in providing a brief summary of the situation at Yetminster in an attempt to give you an
understanding of why Tracey Merritt's contract was terminated.
Regretfully whilst Miss Merritt's contract was terminated, after receiving an admission to using PO funds, we continue to
receive communication from Miss Merritt. You will be aware that her MP has written to Paula Vennell's and Paula has also
been emailed direct by Miss Merritt as recently as the 7" April. Peter Johnson is currently in the process of responding to
this email under the Freedom of Information umbrella.
In addition to Matt's email and what I have previously detailed the current issues for Miss Merritt and equally as important
the service provision to Yetminster are as follows —
e Miss Merritt has requested details of the phone calls made to the branch between the period 3 October 2011
and 14" March 2012. The calls appear to relate to the Horizon system and it is this that Peter is in the process of
reply to Miss Merritt about. It is worth noting that Miss Merritt was suspended at the end of September.
e Miss Merritt appears to be seeking legal advice and going down the lines of “Justice for Sub Postmasters” in
relation to the Horizon system
e POL Security are seeking to prosecute Miss Merritt via a summons. Helen — are you able to update us on any

«The branch remains closed and I understand from Matt that finding a permanent solution is not being assisted by
the local storm that Miss Merritt is creating. The service provision for the village is currently a week Mobile
service.

Although I am actively trying to re-establish a permanent service for Yetminster I have tried to keep the contractual issue
between Tracey Merritt and the Contract Team. I have had to deal with Tracey Merritt with regards to the strip out of the
equipment and any future use of the premises so the contractual issue around the suspension and the subsequent
allegations of the integrity of the Horizon system I have left to the appropriate team and not commented on.
However I have been kept in the loop and in Gary Adderley's absence will try and help with your enquiries.
Yetminster branch was audited on 29/09/12, the auditors were Bill Constant and his line manager Chris Guiding, the audit
was arranged following a full audit request from cash management regarding the ONCH at the branch. The report I
received showed a shortage of £11,886.77 and the report also stated that there was an admission of using POL funds. I
believe that Tracey Merritt has subsequently blamed the Horizon system for the shortages and is taking legal advice on
the matter. I letter was received on 19/01/12 in which Tracey Merritt had decided not to appeal.
I have attached the termination letter sent to Tracey Merritt on 25/11/11 which details the reasons why she was
terminated, a second letter which is regarding debt recovery send before the audit took place and two letters from Tracey
Merritt which first mentions the Horizon system. I have also attached the audit report which includes Tracey Merritt
admitted to using POL funds for personal use.
I hope this is of some help, Gary Adderley returns from AL on Monday 16* April if any further information is required.

The main query on this is around Horizon. However, you will see in his letter, Oliver Letwin refers to
having corresponded with us several times about Yetminster Post Office. Can you provide the history on
this?
