Mark — this is case that was raised by Kevan Jones in the House, for a number of reasons, which I am happy to chat
through we have decided to discontinue this prosecution, could you look at the wording suggested by our legal team
and confirm that this is acceptable with Rod’s addition below. We need to do this on Monday.

Given the size of the shortfall, any response should also reserve POL's rights with respect to civil recovery of the £85k,
eg.

."., there still remains an 85k loss at Mr. Brown's Post Office which remains unexplained by him, AS TO WHICH POL
RESERVES ALL OF ITS RIGHTS."

Further to our tele-con yesterday, please find attached the e-mail chain.

We would suggest a response along the following lines:-

The Post Office are currently engaged in a review of all of those cases presently being prosecuted.
One element of the review involves the continuing application to each case of the Code for Crown

Prosecutors. That Code requires both an evidential test and a public interest test be applied in
each case. The Code also requires the prosecution to keep under review whether or not that test

continues to be met in any individual case.

As part of the review process examining all of the cases presently under prosecution, POL has
determined that in this specific case it is no longer in the public interest to prosecute. Having said
that there still remains an 85k loss at Mr. Brown's Post Office which remains unexplained by him.
