Attended Guildford Crown Court in the case of Seema Misra for Mention. The case
was heard in Court 1. Prosecuting Counsel Elizabeth Small and the Defendant was
represented by Mr Hadrill.

After a long conversation with Counsel Warwick Tatford who hold the Brief on behalf
of the prosecution and a Conference with Elizabeth Small. On the 21* January
2010 a Defence Statement was received although it is referred to as further Defence
Statement. The Defendant had already pleaded Guilty to false accounting and the
matter for the Court is theft and the Trial is fixed for the 15" March 2010.

We discussed the unreasonable disclosure requested by the Defence and that in
what has been functioning properly and that a statement from Mr Jenkins will deal
with the Horizon aspect of the case.

On hearing the submissions on behalf of both Counsels the Judge gave the
following Direction.

1 That any further evidence on which the prosecution sought to rely needs to
be served by 4pm on the 9" February 2010.

2 If the Defence feel there is a proper foundation for a stay application on this
count of theft and potential justification they can make this application.

3 The Defence to fax or E-Mail any further Defence final disclosure by 4pm on
Wednesday 3" February 2010.

4 Costs of today to be reserved.

In light of which discussion with Counsel Warwick Tatford and Jon Longman
throughout the delay and also chasing him with any outstanding further disclosure
and evidence and also the statement from Mr Jenkins. Also discussing the case at
length with Warwick Tatford throughout the day.

On 2” February 2010 spoke to Jon Longman concerning the outstanding
statements of Mr Jenkins and also the matters which he said he could not deal with
but much rather be referred to Post Office Limited to get a statement who would be
able to compensate and explain the matters Mr Jenkins would not be able to.
Mr Longman is chasing that is in the pipeline and he confirmed that he hoped to be
in a position to supply me with these statements by Thursday 4” February 2010.

I also spoke to him on the 3" February 2010 regarding the outstanding statements.
He confirmed that he has spoken and they are on their way and will keep me
informed of the progress.
