All - please see the latest email from the CCRC below, asking for an indication as to when we will be supplying
information.
I propose responding as follows:
- Weare in the process of responding to the notices.
The s.17 Notices provide a time for response which we are working towards, but note that we have been asked
for a broad range of documents for a large number of cases (currently 15) which stretch back over a significant
time period.
We are also arranging a meeting with the CCRC to discuss the Notices, which we anticipate will involve a
discussion around the most efficient way to respond to the Notices for the individual cases.
- We should be able to respond on the “general” notice shortly.
Insofar as the “general” notice is concerned, we can:
produce a copy of the “Rose Report” (copy attached. - the report is marked “Confidential and legally
privileged” but I do not believe any privilege attaches to it. Can we please discuss how we should approach this
when we disclose it to the CCRC?)
provide a copy of S$’s first Pt ll Report dated 21.08.14, along with PO’s response dated 22.09.14, as these have
already been disclosed to some Scheme applicants.
- note that SS is producing an updated Pt I] Report, which should be delivered on 07.04.15 (see my “Observation”
below}.
- confirm preservation of materials relating to the Mediation Scheme and CK case reviews.
- confirm preservation of materials relating to the cases considered by Second Sight insofar as they relate to
Scheme applications.
- state that, as per the “Work Plan” letter sent to SS on 10.03.15 (attached), we have asked SS to return to us all
materials provided to them (and only destroy duplicates}, to the extent that SS may have materials which are no
longer in our possession (e.g. they were provided to SS without PO keeping a copy).
Gavin — can you please draft a formal response to the “general” notice along the lines set out above.
Observation: There has been much clamour for SS’s Pt 1] Report. The cynic in me thinks that this email ~ much like the
telephone call I had with the CCRC shortly before the BIS Select Committee hearing — has been sent at the prompting of
some third party to try to obtain an earlier copy of the report.
tam therefore inclined to send — or at least offer - the draft Pt il received on 11.03.15, along with our draft response
sent to SS on 27.03.15. This may assist us in dispelling any suggestion that we are “gagging” or seeking to improperly
influence the report.

The Commission has received a number of applications from sub-postmasters, in connection with
which we have sent Section 17 notices to Post Office Limited. To help you keep track I thought it
would be helpful to provide a list of the notices sent to date.
In addition to a Section 17 request for a copy of Second Sight’s final report (sent by our Legal
Adviser, Mr Stuart, on 20 March 2015) we have also requested all material related to the cases listed
in the table below. I should be very grateful for an indication of when we can expect to receive the
material. The Commission is keen to avoid any delay in the review of these cases.
