CONFISCATION HEARING
CASE NO: POLTD/0708/0249
The above named Defendant appeared at Guildford Crown Court on the 8"
July 2011. The case was presided by His Honour Judge Stewart. The
prosecution was conducted by Counsel Mr Warwick Tatford and the Defendant
was represented by Mr Haddrill.
Prior to the hearing a Confiscation figure was agreed in the sum of £40,000
although the agreed figure for benefit was £83,469.59. It was considered that
the available amount agreed was a lesser figure of £40,000 because of the
Defendant’s substantial debt. She also informed, through her Counsel, that on
the..intemet_the value of the property in question number
GRO was valued at £170,000.
In the circumstances when the case was heard before His Honour Judge
Stewart he made the following order: -
Confiscation Order of £40,000 to be paid by the 7" January 2012 but in
default the Defendant would be sent to prison for 15 months.
The Court also made a Compensation Order under Section 13(5) and Section
13(6) where the Court ordered a Compensation Order in favour of Post Office
Limited in the sum of £40,000 directed to be net or recovered from the
Confiscation Order to be made payable to Post Office Limited.
The agreed document re confiscation proceedings signed by both Counsel dated
8" July 2011 is enclosed for your information.
