All,

As flagged at the Board on Tuesday, we had a Case Management Conference this morning. At the end of the hearing, the
Judge advised that the formal judgement in the Common Issues trial will not be handed down before the end of

February.

The CMC this morning was to agree the issues to be heard at the third trial in October, and agree the timetable for the
procedural steps ahead of that. Given we received new and somewhat vague alternative options from the Claimants’
lawyers late last night, the Judge adjourned the CMC until Tuesday 12 February in order to give the parties the
opportunity to agree on the scope of the issues to be tried. He did however agree to delay the 3" trial from October to
November.

We'll provide a further update after the CMC hearing on 12 February.
