Subject: Group Litigation - written judgment on previous refused permission to appeal and costs

You will recall that Fraser J refused Post Office’s request for permission to appeal the common issues judgment and
awarded costs (albeit not on an indemnity basis and with a discount). We have been informed today that his Honour will
hand down his written reasons for that judgment later today. Given previous experience, Post Office could be criticised
in the judgment. Our Comms Team, lead by Mark Davies, is involved and up to speed to manage any media reaction.

We already know the outcome but obviously we will review his Honour’s rationale and consider how that may impact
our appeal strategy including the scope of the Appeal. Helen Davies QC is on board and has been supporting with this

work with HSF. A Board Subcommittee has been arranged for next week.

We will provide a further note once the written reasons have been issued and we had an opportunity to assess the
implications.
