This is simply to let you know that there is a costs budgeting hearing tomorrow. The only issue in dispute on the budgets
is the costs expended on settlement. While Fraser may be critical on costs, a dispute about expenditure on settlement
did not seem to us to be unhelpful from a messaging perspective.

It is possible that the judge will mention the handing down of judgment, in which case we shall need to tell him where
we are with the KELs issue.

We will let you know if there is anything significant to report arising out of that hearing.

With apologies for the slight delay, I attach our weekly update.
Key points include:

e@ Inanew judgment (UTB v Sheffield United Ltd), Fancourt J has disagreed with the approach taken by Fraser J in
relation to relational contracts and good faith obligations.

e = The Claimants have written (on a "without prejudice save as to costs" basis) to say they are considering bringing
anew claim for their litigation funding costs as part of the March 2020 Further Issues trial.

e Work on managing the KEL disclosure issue is ongoing. There is a risk this issue will delay the Horizon judgment.
