Postmaster Litigation ;
(e) The Group Litigation Order (GLO) came to court on the 26"

POLB 17/24 SPARROW UPDATE
(a) The GC provided a verbal update on Sparrow.

(b) The GC explained that the group litigation order was heard in
January 2017 and the order had been signed in the week
beginning 20 March 2017. Accordingly there would be further
advertising by Freeths in order to advertise that Postrnasters
could apply to join the litigation group and therefore it was likely
that there would be further adverse press. Postmasters had
until the end of June 2017 to apply to join the action.

(co The General Particulars of Claim were expected imminently
which would set out in more formal terms the legal basis of the
Postmasters' claims. Following receipt of that document, Post
Office would have until the end of June 2017 to prepare and file
its Defence. Subsequently, there would be a case management
conference (expected to be in October 2017) at which the Court
would determine how the claim should proceed thereafter.

{d} The GC noted that there was still no quantification of the
Postmasters’ claims,

POLB 17/68 LITIGATION UPDATE

(a) The Board received a verbal update on the Postmaster Litigation
from the General Counsel, noting sat the Case Management
Conference would be held on 19 October, and the outcome of
the CMC would be directions given by the Court as to the
conduct of the case over the next 12-18 months, There were
key strategic issues to be decided as to Post Office's
preferences for the sequence in which the legal arguments were
to be addressed, and Post Office had receive legal advice as to
the preferred sequence.

(6) The Board discussed the advice and its implications, and
approved the proposed strategy.

GROUP LITIGATION UPDATE (VERBAL)

JM provided an update on the autcome of the Case Management Conference held on
19 October and outlined the dates set for future hearings. She noted that the judge
had indicated that the court dat would not be set by reference to counsei
availability. This posed a potential issue for Post Office in relation to the court hearing
in November 2018 as the lead counsel may not be available due to another trial, and
advised that contingency plans were being developed,

12.3 Postmaster Litigation Update

JM provided the Board with a verbal update on the Postmaster Litigation noting that
there was a procedural hearing scheduled for Friday 2 February. At that hearing the
Court would be requested to determine the scope of disclosure required to be given
by Post Office to suppart the trial in November 2018.

The Board NOTED the update and RESOLVED to establish a sub-committee for the
purposes of monitoring the development in and strategy for the Itigation, The
members of that sub-committee would be the Chairman, Ken McCall and Tom Cooper

(once appointed as @ director). JM was requested te provide the committee

members with details of the key dates mandated by the Court se that JM

appropriate time could be scheduled for the sub-committee to be briefed.

12. POSTMASTER LITIGATION

12.1 The Board NOTED that the Subcommittee established at the previous
meeting had met the previous day and had been updated on the case,

12.2 The Board RESOLVED to APPROVE the terms of reference for the
Postmaster Litigation Subcommittee.
