Reflecting on the PLSG meeting on Thursday a couple of things occurred to me which I thought helpful to share. The first
is that when this Steering Group was originally established (some time ago now) it was as a decision making group with
decisions on the litigation strategy being presented to this group for consideration and a decision or recommendation to
Board. Clearly our approach as a business has changed and decisions are being taken at Board/Board Sub-committee
without the involvement of this group however I don’t believe we’ve formally advised this group of that or amended the
TOR for this Steering Group. The second is the discussion on Thursday referenced a change in our overarching litigation
strategy however this group has not been advised of any change.
Given the above I think it would be helpful to share with this group the governance structure you mentioned a few
weeks back — the one you drew free hand that was being formalised (although I don’t think I’ve seen the finessed
version) — with this group. Also an update on what the business strategy is to the GLO if it has formally changed over the
course of the trials would be helpful so that we are all on the same page during the discussions.
