Having seen martin Smiths earlier emails today. It occurs to me that Susan Crichton and Simon Baker arranged to
send some files directly to second sight.

I was not involved in that process and cannot say what was sent. But lam know concerned that number of prosecution
files may have been sent this may account for their absence.

The CK Review was designed to consider all cases which were active on or after 1° January 2010.

I have just spoken to Jarnail who believes that a significant number of files, possibly as many as 40,
have been provided to Second Sight and in those circumstances would not have been submitted to
CK for review.

This is a cause for some concern. We did not know and were not informed of the existence of these
files until today. However we had earlier warned of the possibility of missing files.

This means that some of the “hottest” files have not been reviewed and may account for the recent
challenge by the JFSA with regard to the statistics.

The sheer number of files omitted from the Review may well undermine the Review process.

It is essential that these files be obtained as a matter of urgency in order that they can be Reviewed.
Are you able to facilitate the recovery of the files from Second Sight?

Just to clarify... did the CK Review of all conviction cases apply to (i) all cases that were subject to prosecution after 1
Jan 2010 or was it just (ii) cases where the events in question happened after 1 Jan 2010 (ie. where the SPMR's
activities took place on Horizon Online)?

Hi Cathal,

This case resulted in a prosecution at the end of which this defendant was sentenced to 18 months
imprisonment on 12" April 2010.

This case was not reviewed during the Cartwright King Review and our records do not show that
we ever received the case. This is something of a worry as the file should have been included as

the parameters included any case that was live from 1* January 2010.

This case involves serious criticism of our investigators which include allegations of bullying,
threatening and lying.

There is a direct attack on the Horizon system, albeit this allegation predates Horizon on Line.

There is reference to the author of the Initial Complaint Review having seen the interview
transcript.

We need to trace the Criminal file in this case as we need to subject it to our review process and
also to address the Initial Complaint Review in an informed manner.

We would accordingly be grateful if arrangements could be made to locate the file and for it to be
forwarded on to us.
