Jarnail,
As matters presently stand, POL does not employ in-house prosecution lawyers; your prosecution
lawyers are Cartwright King. Cartwright King follows the Code for Crown Prosecutors and all of the
other Codes, Practice Directions, Protocols and Guidelines when advising POL on potential criminal
prosecutions and when conducting prosecutions.
Whilst the decision on whether to prosecute or not is taken by a POL employee (be they General
Counsel, Head of Criminal Litigation or Head of POL security), that decision is taken only after
having received written definitive advice from Cartwright King. So long as POL do not initiate a
prosecution where Cartwright King has advised against such a course, POL will be protected from a
Malicious Prosecution claim.

Martin Thanks.
However as in house prosecution lawyers we are officers of the court, follow code for prosecutors ,PACE,
decision on prosecute made by decision maker within the organisation independently, there are other
checks and balances built within the criminal justice system. There fore virtually no chance of any such claim
arising or made out?
