As per our discussion earlier I attach an alternative form of words. Sorry for delay in getting to you. I am also copying

Martin as I have not yet managed to speak to him.

We agreed that depending on the response from Alan we would consider how best to respond to it to ensure that the
matters raised are addressed in some way so that they do not sit on the record unchallenged, and that should Alan
raise this issue at some point in the future we would ensure that the Minister would take a strong line in defence of
the position that she could not herself intervene but that she gave Alan to opportunity to have his concerns addressed
by those best placed to address them. You also confirmed that you would use the submission to make clear the

position to the Minister.

Perhaps we can grab a word in the morning and I hope that I will by then have any additional comments from Martin.
