* Parliament will rightly hold me to account, I expect this to be raised in BEIS Oral Questions next
week and in meetings I regularly have with MPs. Therefore, important POL are sharing
information with BEIS on this on a regular basis.

* Concern I often hear from MPs is that being a postmaster is becoming less attractive with
changes to renumeration — this judgment will add to that concern. What comms are POL doing
with postmasters on the judgment and how will you address their concerns?

* Concerned that the legal advice POL received appears to have been wide of the mark on the
likely outcome of this trial, are you considering any changes to your strategy for the remaining
trials? As you discussed with Alex Chisholm recently, we have learned from previous experience
that it’s very important to have independent legal advice in relation to strategy from now on to
guard against the existing legal team being wedded to the existing approach.

To update those waiting for the call, Kelly wanted SoS to be on the call this evening but unfortunately, he

has a big meeting in his constituency he has to attend. He suggested a call over the weekend, which

As requested, please find below a short summary of today’s judgment, plus the 7 attachments
requested (which I have marked off against your email below).

On Friday 15 March Mr Justice Fraser handed down judgment in the “Common Issues” trial.
The judgment found strongly in favour of postmasters with the principle finding being that the
contract between POL and postmasters places a number of obligations on POL which will
require them to change the way they work with postmasters. The judgment is also highly
critical of POL’s behaviours and uses strong language accusing POL of being heavy handed
and lacking transparency. You can get a flavour of this with the quotes included in the legal
analysis (see Annex 7 pages 2-3).

POL take this judgment and its criticisms very seriously. While the culture and practices of the
business have improved in many ways over the years, they have taken the Judge’s criticisms
on board and will take action throughout the organisation. We (UKGI and BEIS) are urgently
discussing the judgment and the action they will take with POL, we recommend you also have
an call with POL’s Chair to discuss the judgment and emphasise the importance of POL’s
response. We are also updating briefing materials ahead of BEIS Oral Questions next week.

The judgment is long and complex and POL will consider it fully. Some of the conclusions differ
from what POL expected from a legal standpoint and they are therefore considering appealing
on certain legal considerations, however this does not qualify how seriously POL take the
judgment and they will take action to respond to its criticisms. Ministers will be consulted before
any appeals are made.

I thought it would be useful to start a master thread on the judgment of the POL Litigation trail which
was made publicly available this afternoon.
