Martin,

Tony Hooper has sent us the attached document setting out why he thinks mediation is appropriate for Mediation
Scheme Case MO30. The Applicant in that case is Jacqueline MacDonald, former SPM of Broughton PO, who
pleaded guilty to false accounting on 12 April 2010, and to theft charges on 8 November 2010.

Our response to Tony on this case is likely to be based around the scope of the scheme, i.e. it only looked at
specific Horizon issues and not the prosecution (which would involve other considerations). Nevertheless, could
you please comment on the points Tony makes about the prosecution, e.g. in para. 2 his “understanding” that
there were “no other admissions of guilt” (his comment in para. 5 about what is or is not in the papers rather
supports our point that the Scheme is not a criminal case review!).
