Data Subject Access Request - FOI201511171315
We write with reference to your letter of 27 April 2016.

We note that you refer to your “FOI request”. We assume, given the Post Office reference
number that you quote in your letter, that you are referring to your data subject access
request received by Post Office in February 2016. We respond on that basis.

We also note that you are a claimant in High Court litigation against Post Office (Alan Bates
& Others v. Post Office Limited, High Court of Justice Queen’s Bench Division, Claim No.
HQ16X01238).

On 11 April 2016 we sent to you copies of all the personal data located having carried out
detailed searches in response to your request. Those copies totalled XX documents. You
are now asking Post Office to search for further information, including that which is not
your personal data.

In Durant v FSA [2003] the Court of Appeal stated that the purpose of the subject access
request regime is to give an individual the chance to check whether through the processing
of his data, his privacy is being unlawfully infringed. The court stressed that subject access
requests are not to be used to help individuals obtain documents to assist them in
litigation.

To reiterate, we have sent to you copies of all the personal data located. To the extent that
any of the further information you have requested falls to be disclosed in the litigation, it
will be disclosed at the appropriate time through the litigation process. Accordingly, Post
Office does not believe that any further action is required in connection with your data
subject access request.
