Thank you for your time on the telephone earlier today.
As discussed, in case it assist your team’s consideration of the potential financial exposure presented by the
Mediation Scheme, I attach:
1. The Court of Appeal’s decision in Lalji v POL [2003] EWCA Civ 1873, which considers the types of damage
claimed by a SPM for the alleged breach of the standard SPM contract.
The attached is a draft of the subsequently handed down judgment, which can be found at:
http://www. bailii.org/ew/cases/EWCA/Civ/2003/1873.html. I am sorry but I do not know if the decision
under appeal is available (Royal Mail would have it if not destroyed).
2. Draft Advice from Slaughter & May dated 6 January 2006 on “whether the availability of discretionary
payments and compensation schemes regarding Sub Post Offices (“SPOs”) has created a legitimate
expectation that compensation will be payable to Sub Postmasters (“SPMs”) whose SPOs are closed as part
of any future proposed reduction in the numbers of SPOs in the network.”
This was prepared on a “worst case scenario” basis to assist POL pitch discretionary termination payments
for the branches permanently closed under the “Network Change” programme of closures.
As also discussed, I will contact Martin Smith at our criminal law solicitors Cartwright King and let him know that
Jonathan may be in touch early next week.
