I have now had a chance to think about this and it looks good to me. The questions in 1.6 are good ones.

I have 3 comments:-

1) Our concerns include the possible duration of the Scheme and the implications of that, not just in terms of costs,
but also in terms of top management time and effort (distraction from implementing the Strategy).

2) Most important of all, our intention all along has been to do "what is right" in respect of past cases and the
treatment of current and future SPMRs.

We also want to be seen to be doing “what is right" in the eyes of a "reasonable" person (the woman on the top of
the Clapham omnibus), bearing in mind the PAC perspective. We cannot escape the fact that what will be seen as
“reasonable” will be influenced by what the MPs concerned believe about this (but we can influence this up to a
point),

3) Nothing to do with this scoping paper, but it would be useful to see again the paper for the Board which came
round last year about the PO's and its Directors’ legal liability for actions taken in these cases prior to last August.
This is, of course, linked to the insurance position...

I look forward to seeing Linklater's paper.
