Further to our telephone conversation on the 7" September 2009.

I have written to the Defence informing them that the plea on the basis suggested
is unacceptable. I have also informed them that in the event of conviction and the
loss not having been repaid the prosecution would be proceeding to confiscation.

I have also written to Counsel informing him that it may be possible for you to
obtain further information about the bank accounts should the case proceed to tral.
I have also asked Counsel to consider whether or not a charge under the Fraud
Act could be added.

As promised please find enclosed a copy of the Accountant's Report submitted by
the Defence.
