1, I represented the Royal Mail at today’s hearing. Mrs Misra represented herself. The defendant
had provided evidence to the Prosecution and Court that once her house had been sold (the
value of which had made up the realisable amount of the confiscation order) there had not
even been enough money to pay off the mortgage. She confirmed this is court, and confirmed
that she had no other assets. I informed the court that the Prosecution accepted this. The Judge
varied the order under s.23 POCA (inadequacy of available amount), stated that the available
amount was £0, and made a confiscation order in the nominal sum of £1. He stated that it was
pointless to set a time to pay, and time to be served in default.

2. Outside of court Mrs Misra asked me how I could pay. I attempted to call those instructing
me, but could not get through. I advised her to contact those instructing me (she already had
the details) to confirm the payment options.
