The above case was heard on the 25" May 2007. The prosecution was represented
by Tom Bradford, Anita Saran represented the Defendant.
As you know the Defence had required the matter to be listed for Mention. This was
in essence because they had received a great deal of correspondence from the
Defendant. They believed this should have been served by the prosecution.
Prior to the hearing the Defence requested that the prosecution serve the material
upon them. The prosecution's view is that no assurance could be given without an
indication as to what the material is
When the matter was heard the Court adjourned the case for the prosecution to be
given an opportunity to consider the matter and for the prosecution to take a view
as to whether the material was evidence to be relied upon or unused material. The
case has been adjourned until the 10" September 2007.
After the hearing it was suggested by the Defence that the material should be
shown to the prosecution and thereafter the Investigator should be given an
opportunity to examine and determine what the material is. I am writing to the
Defence regarding this.
